Brief Description

This module develops a range of professional skills in client interviewing, negotiation and drafting simple legal documents.

Indicative Syllabus

The techniques and practice of client interviewing including: questioning techniques, recording information and giving advice. The techniques and practice of negotiation including: preparation for negotiation, identifying the parameters within which one is authorised to negotiate, recording the outcome of negotiation. The principles and practice of legal drafting, particularly simple agreements.

Learning Outcomes

A student passing this module should be able to:

1. demonstrate an understanding of the techniques and practice of client interviewing;

2. demonstrate a sound understanding of the techniques, practice and benefits of negotiation as a method of achieving a client’s objectives;

3. demonstrate a sound understanding of the principles of legal drafting;

4. interview a client, explaining legal terminology and concepts in a manner appropriate to the client, identifying the client’s goals and advising orally on appropriate courses of action to achieve those goals;

5. conduct a straightforward oral negotiation, including clear, effective and persuasive presentation of the negotiating position and appropriate response to the opponent’s position;

6. draft simple legal agreements which address the relevant factual and legal issues, meet the client’s goals and are clearly written.
