Brief Description

This module examines the systems of property law in England and Wales and provides an understanding of the main principles of ownership of land, both freehold and leasehold, together with the acquisition, protection and application of third party rights.

Indicative Syllabus

The historic origins and importance of property law in modern society. Understanding what is meant by "land". The two systems of title to land: registered and unregistered including statutory development of the law and the underlying principles. The various types of third party interests in land, to include easements, freehold covenants, licences, options and mortgages and how they arise, are protected and affect property. The two categories of land ownership: freehold and leasehold including acquisition and transfer of both leasehold and freehold property and also leasehold covenants. Ownership of land by more than one party.

Learning Outcomes

A student passing this module should be able to:

1. demonstrate a sound knowledge and understanding of those aspects of property law identified in the indicative syllabus above and form a critical judgement on areas of controversy and/or uncertainty within the topics studied;

2. demonstrate understanding of the social and commercial context of property law and its importance to both private and commercial ownership together with the underlying policy reasons for the changes in property law, past present and those proposed for the future;

3. analyse problems in property law, apply the legal principles studied to these problems and present well supported conclusions, both orally and in writing;

4. read and study primary and secondary sources of property law, with limited staff guidance, access, interpret and use law reports, statutes, secondary legislation and Law Commission Reports;

5. identify sources for research and establish a strategy for research using standard and electronic research tools.
