Brief Description

This module considers the law of tort with emphasis on the major torts of negligence, nuisance, trespass and defamation.

Indicative Syllabus

Introduction to tort, negligence, liability for psychiatric illness and economic loss including public policy considerations, occupiers’ liability, employers’ liability, manufacturers’ liability, nuisance, trespass to land, persons and goods, defamation, remedies.

Learning Outcomes

A student passing this module should be able to:

  1. demonstrate a broad understanding of the fundamental principles of the law of tort;
  2. demonstrate an awareness of social policy considerations in the law of tort e.g. in relation to the types of interests the law seeks to protect;
  3. demonstrate an awareness and general knowledge of areas of difficulty or uncertainty in the law of tort and of proposed areas of reform.
  4. analyse well defined tort problems to identify the relevant legal principles to be applied, apply the legal principles studied to these problems and present reasoned arguments and conclusions.
  5. locate, read and study primary and secondary sources, using both hard copy and electronic materials as directed by staff, read and summarise content accurately and cite and reference source materials correctly.
  6. communicate effectively both orally and in writing, using essential legal terminology correctly.
